JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-08-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 04.04.2016 passed in Cr. Misc. No. 5895 of 2016, on the ground that the petitioner is suffering in custody since 04.09.2015, besides suspicion there is no legal and tangible material against the petitioner, the doctor who has conducted postmortem examination has not given definite opinion regarding the cause of death.

The learned A.P.P. seriously opposes prayer for bail of the petitioner by submitting that the son of the informant has supported the allegation being an eye witness. In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.41577 of 2017 (2) dt.30-08-2017 2/2 finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with S.T. No. 48 of 2016 arising out of Rajoun P.S. Case No. 163 of 2015 pending in the court of 1st Additional Sessions Judge, Banka.

However, considering detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within a period of nine months.
