2. The petitioner apprehends arrest in connection with Tajpur P.S. Case No. 11 of 2024 for the offence registered under Sections 272, 273 and 34 of the IPC and Section 30(a) of Bihar Prohibition & Excise Act.

3. As per the prosecution case, total 306 litres of foreign liquor was recovered from the truck bearing registration no. BR096A6815. It is alleged that the petitioner is the owner of the seized truck.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case being the owner of the seized truck bearing registration no. BR096A6815. The said truck was driven by the co-accused who is the driver and the petitioner h as no knowledge about the

Petitioner was neither present on the spot nor any incriminating article has been recovered from the conscious possession of the petitioner. Further submission is that petitioner has no concern with the seized Bolero bearing registration no. BR09M1731 or liquor. Petitioner has no criminal antecedent. He undertakes to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, (Excise) 02, Samastipur, in connection with Tajpur P.S. Case No. 11 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023. (Sunil Dutta Mishra, J) khushbu/- U T
