====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Sono P.S. Case No. 46 of 2017 for the offences punishable under Sections 121, 121(A)/ 120(B) of the Indian Penal Code, 25(1b)a/26/35 of the Arms Act, 3⁄4 of Explosive Substance Act and sections 16,17,18, 19, 20, 21 of the U.A.P. Act. The petitioner appears to have been arrested from his house during the raid conducted by the police and one loaded country made rifle and one live cartridge was recovered from the room of the petitioner. Further Naxali literature was also recovered.
The learned counsel for the petitioner submits that the petitioner has a clean antecedent and he is languishing in jail since 21.3.2017.
Patna High Court Cr.Misc. No.45839 of 2017 (2) dt.21-09-2017 2/2 Having regard to the facts and circumstances of the case, I may deem it fit and proper to enlarge the petitioner on regular bail immediately on completion of nine months of his custody from the date of his arrest i.e. 21.03.2017, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Jamui in connection with Sono P.S. Case No. 46 of 2017 and also subject to other terms and conditions as may be deemed fit and proper by the learned trial court.
