Having regard to the fact that the petitioner is an employee of a Bank governed by the Bipartite settlement, his remedy as against the order of punishment in a departmental proceeding will definitely lie only before the authorities under Industrial Disputes Act.
When such an observation has been made learned counsel for the petitioner seeks permission to withdraw this application in order to enable the petitioner to take recourse to remedy under the
Patna High Court CWJC No.2292 of 2015 (2) dt.09-02-2015 Industrial Disputes Act.
This application is, accordingly, permitted to be withdrawn with the aforementioned liberty.
