Petitioner is apprehending his arrest in connection with Alauli P.S.Case No.147 of 2019, registered for offences punishable under Sections 341, 323, 448, 427, 354(B), 506 of the Indian Penal Code.

From the prosecution case, it appears that the complainant is wife of the brother of the petitioner rand there is dispute with respect to partition . FIR discloses that earlier the partition took place but the petitioner is not ready to it for which he used to come to her house and assaulting her and disrobing her daughter.

Submission of the learned counsel for the petitioner is that the FIR itself shows that there is partition between the

Patna High Court CR. MISC. No.51801 of 2019(2) dt.20-08-2019 2/2 parties and he has informed about the same to the Gram Katchahri with respect to the occurrence took place with the petitioner, which will appear from Annexure-2 also. Heard learned A.P.P. also.

Having heard both sides and in view of the fact that he has been falsely implicated in this case and the ornamental allegation of misbehaving with her daughter, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Alauli P.S.Case nO.147 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
