The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 and 385 of the Indian Penal Code read with Section 27 of the Arms Act and Section 3⁄4 of the Explosive Substances Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that while he was going to Banka Market, he saw Md. Hasnain, Firdaus, Murad and Arif exploiting money from those who were seeking to cross the river on which he protested, it is next alleged that thereafter he went to the market and while he was returning back, the aforesaid accused surrounded him and

No.60611 of 2022(8) dt.19-06-2023 2/3 when he raised hulla, villagers came to save him on which from the side of the petitioner also twenty one named persons came and started pelting stones and Guddu Ansari threw bomb causing injury to one Sahila Devi, it is next alleged that some of the accused even fired.

Learned counsel for the petitioner submits that the petitioner is named in the FIR, it is also submitted that no doubt an occurrence took place but then the allegation against the petitioner is general and omnibus in nature. Learned counsel further submits that some injured also received gunshot injury but then the FIR does not even remotely suggest that it was this petitioner who fired when admittedly petitioner is a person with clean antecedent. It is further submitted that petitioner will not abscond rather will cooperate in the investigation and will present himself as and when required by the Investigating Officer.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on

No.60611 of 2022(8) dt.19-06-2023 3/3 anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Banka P.S. Case No. 339 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
