JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-02-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Kotwali (Barari) P.S. Case No. 273 of 2017 registered for offence punishable under sections 307, 504, 506/34 of the Indian Penal Code and section 27 of the Arms Act and sections 3/4 of the Explosive Substance Act.
The learned counsel for the petitioner has submitted that petitioner no. 1 is mother-in-law and petitioner no. 2 is sister-in-law (Nanad) of the informant. There is land dispute between the parties. The allegation to point pistol to the informant is on co-accused, Sonu Kumar (Devar of the
Patna High Court CR. MISC. No.55173 of 2022(2) dt.04-02-2023 2/2 informant) and not against the petitioners. The only allegation against the petitioners is that they abused the informant. Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 273 of 2017, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) Mahesh/- U T
