The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code. For land dispute there is specific allegation against the petitioner to have caused injury at the head of the informant. Submission of the learned counsel for the petitioner is that the Doctor has found simple injury. There is no allegation of repetition of blow.
Considering the fact that petitioner had knowledge that his act might cause death, hence, I am not inclined to enlarge the petitioner, above named, on anticipatory bail in connection with Hathua Police Station Case No.109 of 2018
Patna High Court Cr.Misc. No.50820 of 2018(2) dt.25-09-2018 2/2 pending in the court of learned Chief Judicial Magistrate, Gopalganj.
