Petitioner seeks bail in a case registered under Section-47A of the Excise Act.

170 litres beer, kept in several bottles, is said to have been recovered from the Meat shop of the petitioner but submission on behalf of the petitioner is that the aforesaid recovery was made from the shop of one Krishna Mishra, who was running liquor shop at the relevant time and had provided some space to the petitioner for selling the meat. It is further submitted that moreover, the aforesaid recovery was made on 04-04-2016 whereas; the prohibition regarding the Indian made foreign

Patna High Court Cr.Misc. No.37546 of 2016 (2) dt.09-09-2016 2/2 liquor was made applicable from 05-04-2016.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pupri P.S. Case No. 55 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi.
