This is second attempt for grant of bail on behalf of the petitioner in Madanpur P.S. Case No. 112 of 2015 corresponding to Sessions Trial No. 14 of 2016 / 5 of 2016 registered for the offence under section 302/ 201/ 120(B)/ 34 of the Indian Penal Code . Vide order dated 5.10.2016 a report was called for from the court below regarding the stage of the case which has been received and kept on record at flag- 'X' . The report dated
Patna High Court Cr.Misc. No.41655 of 2016 (4) dt.16-11-2016 2/2 21.10.2016 sent by learned Additional District and Sessions Judge- VII, Aurangabad (Bihar) indicates that four prosecution witnesses have already been examined. Since evidence is going on there is no reason to review my earlier order. Prayer for bail again stands rejected.
However, while dismissing it is desirable to observe that that learned trial court may take appropriate step so that case may come to its logical end without unnecessary delay. (Rakesh Kumar, J) Praful/- U T
