JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is named in the first information report and informant claimed that petitioner and two F.I.R. named accused as well as some unknown persons assaulted the deceased. The informant also claimed that prior to his death deceased disclosed that he was mercilessly assaulted by the petitioner and others. Submission on behalf of the petitioner is that deceased was killed by some unknown persons but petitioner has been implicated in this case on account of previous enmity and

Patna High Court Cr.Misc. No.38855 of 2016 (3) dt.15-11-2016 2/2 moreover, no specific overt-act has been attributed against the petitioner and the post mortem report does not support the allegation. Petitioner is in jail custody since 11.01.2016 and the investigation against him has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Baliya P.S. Case No. 228 of 2015.
