Mrs. Rina Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, this petitioner along with other accused persons, armed with deadly weapon, entered into house of the informant. Thereafter, co-accused, Sipath Lal Singh assaulted the informant with iron rod on his head. Co-accused, Rakesh Singh, assaulted with Farsa to Ram Baharosh Singh (deceased). Co-accused, Ram Bahadur Singh assaulted the informant's wife with Lathi. Other accused persons are also alleged to have assaulted as a result of which three persons sustained injuries out of whom Ram Bharosh Singh died.
Patna High Court CR. MISC. No.66003 of 2021(2) dt.14-07-2022 2/2 Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Specific allegation of assault is against co-accused, Sipath Lal Singh, Rakesh Singh and Ram Bahadur Singh. There is general and omnibus allegation against this petitioner. Post mortem report shows that only two injuries were found on the deceased.
Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner is named in the FIR and in the occurrence three persons sustained injuries out of whom one died.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
