2. The petitioner seeks regular bail in connection with Raghunathpur P.S. Case No. 48/2023, registered for the offence punishable under Section 414 of the Indian Penal Code & Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per prosecution, 392.500 litres of country made liquor has been recovered from the motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been made implicated in this case. Nothing incriminating has been recovered from the possession of the petitioner and he is in jail since 25.07.2023. Similarly situated co-accused has already granted bail by this Hon'ble Court vide Cr. Misc. No. 41698/2023 dated 24.07.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Exclusive Special Excise Court no. 2, Siwan, in connection with Raghunathpur P.S. Case No. 48/2023. (Sandeep Kumar, J) Ranjeet/- U T
