JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Petitioner is languishing in custody since 20.03.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 386, 379, 337, 323, 436, 307, 332, 353, 427 of the Indian Penal Code.

The prosecution case is that one truck dashed an auto rickshaw when truck was chased resulted into crushing of 8 people and causing injuries to several others. It is alleged that subsequently a mob of 1500 people attacked the police pelted, stones and put the vehicles of the check-post on fire. For the same incidence three cases were registered being Buxar(T) P.S. Case No. 117 of 2015, Buxar(T) P.S. Case No. 118 of 2015 and Buxar(Industrial) P.S. Case No. 32 of 2015. It is submitted by learned counsel for the petitioner that accusation is against the mob and in order to save its skin the police lodged frivolous cases. The petitioner

Patna High Court Cr.Misc. No.26269 of 2015 (2) dt.27-07-2015 2/2 has been made accused in all the three cases. Moreover coaccused have been granted bail vide Cr. Misc. Nos. 26061 of 2015 and 24482 of 2015.

Considering the accusation against the mob and the investigation being concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(T) P.S.
