Nurul Hoda For the Opposite Party/s : Mr. Shakir Ahmad (App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 20-01-2015 The petitioner is in custody since 25.06.2014 in relation to Jokihat (Mahalgaon) Police Station (PS) Case No 297 of 2013 instituted under Sections 376, 312 of Indian Penal Code. It is submitted that the allegation at best is that on the promise to marry, the petitioner had sexual relationship with the prosecutrix who is assessed to be a major. It is submitted that it is a case of false implication. Petitioner is already married and with children which was known to the prosecutrix.

Be that as it may, the petitioner abovenamed is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Jokihat (Mahalgaon) PS Case No 297 of 2013.
