The petitioner seeks bail in Khagaul P.S. Case No. 208 of 2013, registered for the offences punishable under Sections 406, 420, 323, 504, 120(B) and 34 of the Indian Penal Code. The complainant made allegation that she was intending to purchase of house and she came in contact with the petitioner who sold a half constructed building. The petitioner is alleged to have taken Rs. 3,79,000/- from the complainant on assurance to execute the sale-deed but the complainant later on came to know that the land and the house does not belong to the petitioner. The petitioner did not return the money.

It is submitted that the petitioner has not taken any money from the complainant. The petitioner is in jail since 31.10.2013. On the other hand, learned counsel for the informant-

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that the petitioner is in jail for about one year and ten months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, in connection with Khagaul P.S. Case No. 208/2013.
