The petitioner seeks bail in Bettiah (M) P.S. Case No. 319/2016 registered under Section 411 of the Indian Penal Code. The petitioner was apprehended with a motorcycle bearing registration no. BR-22R-1579. The petitioner did not produce papers with regard to the ownership of the motorcycle. Learned counsel for the petitioner submits that no motorcycle was recovered from the possession of the petitioner. The petitioner happens to be the son of the Mukhiya and he has been falsely implicated in the case. The petitioner is in jail since 18.07.2016. Learned A.P.P., however, opposed the prayer for bail but submitted that during the course of investigation, the investigating officer did not find that the motorcycle recovered from the possession of the petitioner is a theft one.

No.39643 of 2016 (3) dt.01-12-2016 2/2 Considering the facts aforesaid, the nature of allegation made against the petitioner and the fact that the petitioner is in jail for more than four months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah (M) P.S. Case No. 319 of 2016.
