JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Daudpur P.S. Case No.126 of 2017, registered for offences alleged under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is allegation that some of the accused persons, who had unlocked the luggage of the informant and had taken out ornaments and cash, finally boarded on a Bolero Jeep which belonged to the petitioner. Learned counsel further submits that Bolero Jeep is running on hire basis and is carrying passengers. So far as the present petitioner is concerned, he was not in the said Bolero Jeep

Patna High Court Cr.Misc. No.44604 of 2017 (2) dt.20-09-2017 and he has got clean antecedent. The police has arrested him only because he happens to be the owner of the Bolero Jeep. Learned APP for the State opposed the prayer for bail.

In the facts and circumstances, let the petitioner, namely, Sailen Sah @ Salen Sah be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri R.M. Tripathi, the learned Judicial Magistrate, Chapra, District-Saran in connection with Daudpur P.S. Case No.126 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
