The petitioner seeks bail in a case for the offences punishable under sections 379 and 411/34 of the I.P.C The prosecution story, in brief, is that when the informant was sleeping he heard the sound of Buffalo and found that Buffalo was stolen away by two thieves one of which was caught and other fled away.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 30.3.2015. Charge sheet has been submitted in the case. It is further submitted that the petitioner has been made accused in the present case due to mistake of fact. Other co-accused have already been granted bail by a Bench of
Patna High Court Cr.Misc. No.26805 of 2015 (2) dt.28-07-2015 2/2 this Court in Cr. Misc. no. 48601 of 2014.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K.II, J.M. 1st Class, Udakishunganj Madhepura in Chausa P.S.
