The petitioner apprehends his arrest in connection with Beldour P. S. Case No. 74 of 2017 instituted under Sections 341, 323, 307, 447, 504 and 506/34 of the Indian Penal Code. The allegation, in brief, is that informant's wife is alleged to have practiced witch-craft against the accused persons and on that account the petitioner assaulted her. It is submitted that the petitioner and the informant are neighbours and there is general allegation that he threw the informant on the road and the injury is simple in nature and later on the informant has also filed a compromise petition, in fact this case was lodged due to other dispute.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.37719 of 2017 (2) dt.16-08-2017 2/2 circumstances, let the petitioner, namely, Devawarat Choudhary @ Sachita Choudhary @ Deobrat Choudhary, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Khagaria, in connection with Beldour P.S.Case No. 74 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
