The petitioners are languishing in custody since 24.01.2015 and 20.01.2015 respectively in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The FIR was lodged when one Chhote Manjhi phoned the informant that his father has been killed. In course of investigation, Chhote Manjhi claimed himself to be eyewitness and stated that he had seen the petitioners and other accused persons committing the alleged crime. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.26850 of 2015 (2) dt.28-07-2015 2/2 petitioners that had Chhote Manjhi been an eye witness nothing precluded him to disclose this fact when the informant got his fard-beyan recorded and when he informed the informant through phone about the death of the father of the informant. It is further submitted that similarly situated co-accused Ghultan Ravidas and Rudal Ravidas have been granted bail vide Cr. Misc. Nos. 21601 of 2015 and 25714 of 2015.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Masaurhi at Patna in connection with Masaurhi P.S. Case No. 465 of 2013.
