The petitioner seeks bail in a case for the offences punishable under sections 25 (1-b) a, 26 and 35 of the Arms Act and section 3⁄4 of the Explosive Substance Act. The prosecution story, in brief, is that while the informant along with police official was on patrolling duty near Barhari Bridge they saw a pickup van coming towards Lakhisarai then they stopped the vehicle and as soon as the vehicle stopped the culprits starting fleeing away and on chase they were apprehended and on search 9 M.M. country made loaded pistol and one mobile was recovered from possession of Kundan kumar yadav, one country made loaded pistol and five cartridges and a
Patna High Court Cr.Misc. No.26759 of 2015 (2) dt.28-07-2015 2/2 mobile from Rahul kumar and one country made pistol and two cartridges from Subody Kumar and one loaded pistol with four live cartridges from Bablu and on query they disclosed the names of other culprits.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 10.12.2014. Charge sheet has been submitted in the case. As per allegation one country made pistol and four live cartridges is said to have been recovered from possession of the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. Sheikhpura in S.Tr. No. 68 of 2015 arising out of Sheikhpura P.S. Case No. 486 of 2014. (Sudhir Singh, J) Abhay/- U T
