JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-09-2016 Learned counsel for the petitioner is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioner and the State. The petitioner being husband of the daughter of the informant is languishing in custody since 4.6.2016 in a case registered under Sections 498A, 323,341,504 and 495/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of dowry demands. It is also alleged that the petitioner by concealing his earlier marriage, performed marriage with the daughter of the informant.

It is submitted by the learned counsel for the petitioner that the informant was knowing that the petitioner was married

Patna High Court Cr.Misc. No.42844 of 2016 (2) dt.29-09-2016 2/2 from before, even then the informant chose to marry his daughter with the petitioner. The petitioner is still ready to keep the informant's daughter as wife with full dignity and honour. Statement to that effect has been made in paragraph 7 of the petition which reads as follows:

"That, it is further submitted that the petitioner is husband and ready to keep the victim lady with all dignity and honour."

It is further submitted that the investigation has already concluded.

Considering the fact that investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM III, Nawada in connection with Nawada Mahila P.S. Case No. 32 of 2016.
