The petitioners seek bail in Kumar Khand P.S. Case No.157 of registered under Sections 341,323,324,307,379,504,506 and 34 of the Indian Penal Code. The prosecution case, in brief, is that a written application was filed by one Birendra Yadav before the S.H.O., Kumar Khand P.S. stating that all the accused persons came having armed with Bhala, Farsa, Dabiya, etc. and uprooted the trees of the informant. Upon objection, the accused persons including the petitioners abused, assaulted and took Rs.2250/-. It is submitted on behalf of the petitioners that the

No.16260 of 2015 (2) dt.10-06-2015 present occurrence is said to have taken place due to land dispute and uprooting of plant which was on the land of the petitioners and in the course of hot exchange, assault is said to have taken place. Further from a perusal of Annexure-2, it appears that the injury sustained is simple in nature. It is further submitted that the petitioners have got no criminal antecedent and they are in custody since 16.2.2015.

On behalf of the State, it has been submitted that the petitioners are named in the first information report. Considering the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M., Madhepura in Kumar Khand P.S. Case No.157 of 2014.
