JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant claims that one country made carbine and three live cartridges were recovered from conscious possession of the petitioner but the report of ballistic expert goes to show that one single barrel loaded gun and three live cartridges were recovered from conscious possession of the petitioner and, therefore, the report of ballistic expert makes it clear that no carbine has been recovered from conscious possession of the petitioner.

No doubt, petitioner does have some criminal antecedent but in the present case, he is in jail custody since

Patna High Court Cr.Misc. No.38882 of 2016 (3) dt.17-11-2016 2/2 11.02.2016 and investigation against him has already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patnacity in connection with Bahadurpur P.S.Case No. 25 of 2016.
