The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 325, 307, 379, 504 and 34 of the Indian Penal Code.

The prosecution case, in brief, is that while the informant was returning his village, the accused persons intercepted him and started to assault him. It is also alleged that a mobile phone and Rs. 12,000/- was snatched by the accused persons. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. The

Patna High Court Cr.Misc. No.58565 of 2018 (2) dt.08-10-2018 injury is said to be simple in nature. The matter has already been compromised between the parties vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saur Bazar (O.P. Baijnathpur) P.S. Case No. 490 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
