2. The petitioner is in custody in connection with Imamganj P.S Case No. 13 of 2014 registered for the offences punishable under Sections 147, 148, 149, 120(B), 121(A), 122, 124(A), 307, 353 of I.P.C and Section 25(1-b)a/26/35 of Arms Act and 3/4/5 of Exclusive Substance Act and Section 20 U.A.P Act, and Section 117 of CLA Act.
3. As per prosecution case, it is alleged that petitioner is involved in terrorist activity and gathered huge quantity of arms and ammunition.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further

No.55036 of 2025(3) dt.16-10-2025 2/3 submitted that nothing specific has been alleged against the petitioner rather the name of this petitioner has been incorporated on suspicion. It is also submitted that petitioner is in judicial custody since 20.05.2025. It is further submitted that co-accused have already granted regular bail by the Co-ordinate Benches of this Court vide order dated 05.08.2015 passed in Cr. Misc. No. 28394 of 2015 and vide order dated 07.10.2015 passed in Cr. Misc. No. 26914 of 2015.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order, it appears that petitioner is not arrested on the spot and his named transpired by the local chowkidar. Nothing has been recovered from the conscious possession of the petitioner. Moreover, coaccused have already granted regular bail by the Co-ordinate Benches of this Court vide order dated 05.08.2015 passed in Cr. Misc. No. 28394 of 2015 and vide order dated 07.10.2015 passed in Cr. Misc. No. 26914 of 2015.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of
Patna High Court CR. MISC. No.55036 of 2025(3) dt.16-10-2025 3/3 the like amount each to the satisfaction of learned J.M 1st Class, Sherghati at Gaya in connection with Imamganj P.S Case No. 13 of 2014, subject to condition that petitioner shall remain physically present each and every date fixed by the trial Court till conclusion of the trial and petitioner shall not go outside of the jurisdiction of the concerned trial Court without permission of the trial Court.
