The petitioner seeks bail in connection with Manihari P.S. Case No.14 of 2015 for the offence punishable under Section 363 and 366A read with Section 34 of the Indian Penal Code and Section 3(i) (v) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.

The prosecution story, in brief, is that on 26.01.2015 at about 8.00 A.M. the daughter of the informant, namely, Sangeeta Kumari, aged about 12 years, had gone to the Middle School, Hasbar to attend Flag Hoisting Ceremony but she did not return to her house till evening. Thereafter the informant started to search her daughter and lastly she was not traced out. During course of search, she got information that her daughter had been taken away by the petitioner

Patna High Court Cr.Misc. No.16500 of 2015 (2) dt.10-06-2015 2/2 on his motorcycle on which she went to the house of the petitioner and asked his father about the occurrence but he did not reply anything about her daughter rather he abused her. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case and the said fact is evident from the statement of the victim girl made under Section 164 of the Code of Criminal Procedure which is Annexure-2 to the present application. From perusal of Annexure-2 it appears that the victim girl has admitted that she had left the house along with the petitioner on her own will without any force and she has married with the petitioner. It has further been submitted that the petitioner has got no criminal antecedent and he is in custody since 09.02.2015.

On behalf of the State it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S. Case No.14 of 2015.
