The petitioner seeks regular bail in connection with Konch PS case no. 04 of 2017 registered for the offences punishable under Sections 341, 354, 354(A)(i)(ii), 354(B), 354(D), 506, 509 of Indian Penal Code besides POSCO Act. The case of the prosecution is that while the victim girl was going to tution, the petitioner herein is said to have forcibly made her to sit on his motorcycle and had taken her away and thereafter, tried to commit rape on her however, some girls came at the said place and the petitioner fled away. Learned counsel for the petitioner submits that the victim girl, in her statement under Section 164 of Code of Criminal Procedure which is Annexure-2 to the present petition,

Patna High Court Cr.Misc. No.45854 of 2017 (2) dt.21-09-2017 2/2 has not supported the contents of the FIR and has also not supported the allegation of rape leveled against the petitioner herein as well as turned hostile in the trial. It is further submitted that the petitioner has clean antecedent and is in custody since 01.07.2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. District Judge 1st-cum-Special Judge, Gaya in connection with Konch PS case no. 04 of 2017.
