The petitioner seeks bail in connection with Kasim Bazar P.S Case No. 10 of 2016 registered for the offence punishable under Section 387 of the Indian Penal Code. Petitioner is not named but from perusal of the impugned order it reveals that the name of the petitioner came in the confessional statement of co-accused Sachin Kumar and after that petitioner was arrested and remanded to jail custody since 08.04.2016. Paragraph three of the petition goes to show that after arrest in the present case, petitioner was remanded in two other cases which have been lodged against unknown persons. Similarly situated co-accused Akash Kumar has been allowed bail vide Cr.
Patna High Court Cr.Misc. No.37893 of 2016 (2) dt.23-09-2016 2/2 Misc. No. 31512 of 2016 by another co-ordinate Bench of this Court and further Sachin Kumar has also been allowed bail vide Cr. Misc. No. 36436 of 2016 by another co-ordinate Bench of this Court and, as such, petitioner deserves sympathetic consideration. In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Kasim Bazar P.S. Case No. 10 of 2016, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
