The petitioner seeks bail in a case instituted for the offences under Sections 22(b) of the N.D.P.S. Act and 18(a)(i), 18(c), 27(a) and 27(b) of the Drugs and Cosmetics Act. The prosecution allegation case in short is that on a raid conducted by the conducting team, huge quantity of intoxicating medicines were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. 43 empty bottles of Onerex cough syrup, 10 bottles of Onerex cough syrup and 300 tablets

Patna High Court CR. MISC. No.51997 of 2019(2) dt.21-08-2019 2/2 of Nitravet and other medicines have been recovered. Other coaccused has been granted bail vide order dated 16.8.2019 passed in Cr. Misc. No. 50926 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/ Special Judge, East Champaran at Motihari in connection with N.D.P.S. Case No. 52 of 2019 arising out of Raxaul P.S. Case No. 244 of 2019.
