====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Pramendra Kumar Singh, learned counsel for the petitioners and Sri Nand Kishore Prasad , learned Additional Public Prosecutor.

Two petitioners who are in custody since 15.07.2017 in Mali P.S. Case No. 54 of 2017 registered for the offence under Section 30(a) and 38 of the Bihar Excise (Amendment) Act, 2016 has prayed for grant of bail .

It was submitted by learned counsel for the petitioners that both the petitioners were occupant in a Maruti Esteem Car alongwith other three persons. The said Car was intercepted by the police and from dicky of the vehicle about 160 liters of country made liquor was recovered. It has been submitted that out of five accused , three have already been granted bail .

No.42484 of 2017(2) dt.15-09-2017 2/2 Learned counsel for the petitioners has also drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioners are having clean antecedent. Considering the nature of accusation, clean antecedent of the petitioners as well as period of custody, let both the petitioners Sonu Singh and Ranjan Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -VII- cum- Special Judge, Aurangabad / concerned court in connection with Mali P.S. Case No. 54 of 2017.
