The petitioner is languishing in custody since 06.12.2014 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

The accusation is of committing robbery in the petroleum dealership of the informant. The name of the petitioner sprang up during investigation on confession of the coaccused. It is submitted by learned counsel for the petitioner that neither there is any recovery from the petitioner nor the petitioner has been put on TIP. Though, the petitioner was

Patna High Court Cr.Misc. No.26879 of 2015 (2) dt.28-07-2015 2/2 identified through CCTV footage.

It is submitted by learned counsel for the petitioner that the CCTV footage does not suggest that the petitioner was actually committing robbery.

Moreover, investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial Area P.S. Case No. 31 of 2014.

Since the petitioner has criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
