JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, the present case was lodged against unknown for the offences of Section 365 of the Indian Penal Code but subsequently, in course of investigation, the dead body of the deceased was recovered from a well and accordingly, Sections 302, 201, 120B, 379/34 of the Indian Penal Code were added. However, it came to light that deceased had four wives and the informant was his fourth wife, who was residing with the deceased which had caused annoyance to third wife of the deceased and it is alleged that it was third wife of the deceased who having entered into conspiracy along with petitioner and some others got eliminated the deceased.
Patna High Court Cr.Misc. No.37515 of 2016 (3) dt.10-11-2016 2/2 Submission on behalf of the petitioner is that except the aforesaid suspicion, there is nothing against the petitioner, who happens to be cousin brother of third wife of the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Munger in connection with Sessions Trial No. 123 of 2016 arising out of Nayaram Nagar P.S. Case No. 162 of 2015.
