====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioners. The petitioners seek regular bail in connection with Patahi P.S. Case No. 25 of 2017, G.R. No. 707 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.

The case of the prosecution is that the tractor of the informant was stolen from his house, resulting in filing of the FIR against unknown persons.

The learned counsel for the petitioners submits that the petitioners have been made accused when they were apprehended in connection with Piprakothi P.S. Case No. 53 of 2017, and they have been remanded in the present case and made an accused,

Patna High Court Cr.Misc. No.37968 of 2017 (2) dt.10-08-2017 2/2 although neither any recovery has been made from them, nor there is any material to connect them with the alleged occurrence. It has been further submitted that the petitioners have already been granted bail in the aforesaid Piprakothi P.S. Case No. 53 of 2017. The petitioners are in custody since 1.5.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the petitioners, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Patahi P.S. Case No. 25 of 2017. (Mohit Kumar Shah, J) BTiwary/- U T
