====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30 (a), 33, 37 of the Bihar Prohibition and Excise (Amendment) Act, 2018. Allegedly, 18.6 litres of country made liquor has been recovered from the house of the petitioner. After seeing the police, petitioner fled away.

It is submitted by learned counsel for the petitioner that petitioner is innocent and committed no offence. He has been falsely implicated in this case. No occurrence in the manner as alleged has ever taken place. The entire prosecution version is full of concoction and fabrication. He has no concern either with the seized liquor or the place of recovery or any trade of

His name has been transpired in this case on the statement of his wife. Petitioner has one criminal antecedents of similar nature as mentioned in para-3 of this application.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, huge recovery of liquor from the house of petitioner, I am not inclined to enlarge him on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.
