JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2018 Earlier prayer for bail of the petitioner was dismissed twice on merit, one by a Coordinate Bench of this Court vide order dated 29.02.2016 passed in Cr. Misc. No. 50457 of 2015 and by this Court vide order dated 03.02.2017 passed in Cr. Misc. No. 39493 of 2016.

Submission of learned counsel for the petitioner that he has been in custody for last two and half years and the case is still pending for appearance of other accused persons. Earlier a report was called for, from which it appears that due to non appearance of co-accused, record is presently posted at the stage of appearance. His bail bond was cancelled and non bailable warrant was issued against the said coaccused.

No.47831 of 2017 (4) dt.10-01-2018 2/2 In such view of the matter, I am not inclined to enlarge the petitioner on bail, however, since the petitioner has been in custody for long, trial court is directed to expedite the trial and try to conclude the same as soon as possible by conducting the trial on regular basis, even by separating the trial of this petitioner from the trial of other co-accused persons.

With the above observation, this application is dismissed.
