JUSTICE BIBEK CHAUDHURI ORAL ORDER 25-08-2025 It appears from the submission made by the learned Advocate for the petitioner that the petitioner is aggrieved against an order passed in Misc. Case No.1433M/2024 under Section 163 of the B.N.S.S.

2. The dispute regarding alleged nuisance and apprehended danger arose in connection with ownership and possession of a piece of land, only because of such dispute, an order under Section 163 of the B.N.S.S. cannot be challenged by filing a writ petition alleging that the dispute involves land matter.

3. Considering such circumstances, this Court is of the

Patna High Court CWJC No.13491 of 2025(2) dt.25-08-2025 2/2 view that the instant writ petition is not maintainable. However, petitioner is permitted to file appropriate writ petition challenging the order passed under Section 163 of the B.N.S.S. by filing Cr.W.J.C.

4. Accordingly, the instant writ petition is disposed of with the aforesaid liberty.
