JUSTICE SHIVAJI PANDEY ORAL ORDER 16-06-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Bela P.S.Case N. 27 of 2014 registered u/s 412 IPC. On the statement of informant before the S.H.O., Bela Police Station, the present FIR was lodged, wherein the informant has stated that he was working as Darban in M/s Sanjay Foundary and Engineering work factory which is situated in Bela Industrial area and 24th October 2014 in the midnight while he was on duty as Chaukidar, 10-12 boys aged about 20 - 25 years covering their face came to the factory, jumped on the boundary wall and on the point of pistol had beaten the informant and caught him and further told him that if he will raise alarm, he will be killed. Allegation has been made that the accused persons
Patna High Court Cr.Misc. No.15961 of 2015 (3) dt.16-06-2015 2/2 snatched his mobile and also the key of the factory gate from the pocket of the informant and looted the articles and thereafter the fled away with the looted articles of the factory loaded on two pick-up vans.
Counsel for the petitioner submits that the petitioner has not been named in the FIR nor has been put on T.I. Parade nor any incriminating article has been recovered from his possession. Petitioner is in custody since 13th November 2014. In the facts and circumstances of the case, petitioner Jitesh Paswan is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Bela P.S.Case No. 27 of 2014.
