This application is for grant of regular bail in connection with Rosera P.S.Case No.181 of 2007, for the offences punishable under Sections 147, 149, 341, 323, 324 and 307 of the Indian Penal Code.
The petitioner is not named in the F.I.R. The case is under Section 302 and various Sections of the IPC. It further appears that the case is of the year, 2007 and as the petitioner had not appeared earlier so his trial has been separated and now the petitioner has surrendered/arrested on 23.3.2017. Submission of the learned counsel for the petitioner is that all other co-accused persons have been granted bail and the case is of similar in nature. Now the petitioner is in custody for 4
Patna High Court Cr.Misc. No.34792 of 2017 (3) dt.07-08-2017 2/2 1⁄2 months. Sessions of the trial of the petitioner has been separated from the other accused persons.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact as the petitioner was earlier absconder and the sessions of the trial of the petitioner has been separated, as such, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial after framing of the charge and once the charge is framed against the petitioner, the petitioner may be released in connection with Rosera P.S.Case No.181 of 2007 to the satisfaction of A.C.J.M., Rosera, District- Samastipur. With the aforesaid observation, this application is disposed of.
