JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioner is languishing in custody since 03.05.2014 in a case registered for the offences punishable under Sections 302, 201/34 of the I.P.C.
Accusation is killing Dwarika Yadav and throwing the dead body. The name of the petitioner sprang up on confession of Pintu Kumar. Subsequently the petitioner made confession.
It is submitted by learned counsel for the petitioner that only on the basis of confession before the police the petitioner has been roped in when there is no direct evidence collected by the Investigating Agency during investigation.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.40305 of 2014 (3) dt.16-01-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Nawada in connection with Sirdalla P.S. Case No. 239 of 2013, Sessions Trial No. 244 of 2014.
Let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions during trial.
