The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 432 bottles each containing 375 ml, i.e., total 162 litres of foreign liquor were allegedly recovered from the community hall which is said to be stored by the petitioner for sale. Petitioner claims that he is having clean antecedent and is in custody since 12.07.2017. Considering the facts and the circumstances of

No.39188 of 2017(2) dt.19-08-2017 2/2 the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-1, Sheikhpura in connection with Barbigha P.S. Case No. 30 of 2017 (Excise Case No. 577 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
