2. In this case, the petitioner is seeking regular bail in connection with Maharajganj Excise P.S. Case No. 71 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act 2016 (Amended 2022).

3. As per allegation, on the basis of a secret information, the informant along with along with other police personnel reached at the place of occurrence and total 138.240 L of foreign liquor and 192.00 L beer recovered. The petitioner was also apprehended from the place of occurrence.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated.

Patna High Court CR. MISC. No.58968 of 2024(2) dt.27-08-2024 2/2 The petitioner is neither the owner nor the renter of the house wherefrom the illicit liquor has been recovered. The petitioner is under custody since 23.06.2024 and he is a person of clean antecedents.

5. On the other hand, learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge II, Siwan in connection with Maharajganj Excise P.S. Case No. 71 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
