The petitioners seek bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code and under Sections 3/5 of the Explosive Substances Act.

Some miscreants entered into the house of the informant and on alarm one miscreant namely Md. Abbas was apprehended by the informant and his family members who disclosed the name of the petitioners. One of the co-accused namely Rajendra Yadav @ Raju was also apprehended by the villagers but he was killed.

It is submitted that the petitioners are father and son and it is highly improbable that both father and son would participate

Patna High Court Cr.Misc. No.28328 of 2015 (2) dt.05-08-2015 2/2 in dacoity. The petitioners were apprehended on 13.04.2015, but they have not been put on test identification parade. The petitioners have got no criminal antecedent.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Araria in Jokihat P.S.
