The petitioner seeks bail in Mahila P.S. Case No. 38/2015, registered for the offences punishable under Section 376 of the Indian Penal Code.

The prosecutrix alleged that while she was coming to her house, the petitioner chased her and forcibly committed rape with her. The petitioner threatened her of dire consequences. The prosecutrix further alleged that she became pregnant and later on the petitioner and others tried to get her aborted. Learned counsel for the petitioner submits that the petitioner is ready to marry with the prosecutrix. Learned counsel for the informant has also submitted that the prosecutrix is also willing to marry with the petitioner.

Considering the nature of allegation made against the petitioner and the fact that the petitioner and the prosecutrix are willing to solemnize marriage with each other, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Mahila P.S. Case No. 38/2015.
