JUSTICE RAVI RANJAN ORAL ORDER 13-03-2015 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

Petitioner is cousin brother of the husband of the deceased.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against all the accused persons. The police submitted charge sheet against the husband of the deceased, namely, Md. Afsar but the petitioner was not sent up for trial. However, cognizance has been taken vide Annexure-3 as against the petitioner also under Section 304(B)/34 of the I.P.C. It is further submitted that the husband of the deceased, i.e., the

Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Md. Nisar be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Maniyari P.S. Case No.63 of 2012, G.R. No.1183 of 2012 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, West Muzaffarpur, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
