Mr.Meena Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-08-2024 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Raghunathpur P.S. Case No. 82 of 2024 for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2022.

3. As per allegation, on a secret information, the informant along with police personnel reached the place of occurrence. Seeing the police party, the accused persons succeeded to flee away. On search, 94 liters of fermented Mahua was recovered from the bush.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.59442 of 2024(2) dt.27-08-2024 2/2 this case. He has further submitted that nothing was recovered from the possession of the petitioner. The petitioner is under custody since 06.06.2024.

5. On the other hand, the learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances coupled with the fact that the petitioner has got two criminal antecedents, the petitioner above-named is directed to furnish bail bond after four months from today and on doing so, the court below shall release the petitioner on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Siwan in connection with Raghunathpur P.S. Case No. 82 of 2024, subject to the condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
