However, considering the pendency of the cases relating to anticipatory bail, it is difficult to accede to the prayer made on behalf of the petitioner.

Perused the records.

The petitioner seeks bail in anticipation of his arrest in connection with Naugachhiya Rail P.S. Case No. 2 of 2018 dated 07.01.2018 instituted for the offences under Section 379 of the Indian Penal Code.

A burglary was committed in the train and the name of the petitioner has transpired in the confession of a

Patna High Court Cr.Misc. No.56137 of 2018(2) dt.10-12-2018 2/2 co-accused. Normally, on such evidence, this Court grants anticipatory bail. However, in the present case, from the impugned order, it appears that for similar kind of offences, petitioner has been made accused in not less than eleven cases.

Considering this background of the petitioner, I am not inclined to grant anticipatory bail to him. The petition is dismissed.

However, in case the petitioner surrenders and seeks bail, the court below shall consider it on its own merits, without being prejudiced with the fact that the present petition has not been entertained.
