The petitioner seeks bail in Narhat P.S. Case No. 53 of 2019, instituted for the offence under Section(s) 341, 323, 354, 504, 506 of the Indian Penal Code and Section 37(b) (c) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that on the date of occurrence, when the informant was sleeping in the room, petitioner along with other accused entered into the house and started abusing the informant. The informant came out of his room and protested, then the accused persons assaulted him with fist and slap. Allegation against co-accused Dilip Saw is that he opened his pant and told that he will commit illegal act with the wife of informant.
Patna High Court CR. MISC. No.51880 of 2019(2) dt.26-08-2019 2/2 Counsel for the petitioner submits that petitioner is next door neighbour. The dispute arose between the parties for passage. He further submits that petitioner has been falsely implicated in the case.
Petitioner is in custody since 2.7.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II, Nawada, in connection with Narhat P.S. Case No. 53 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
