JUSTICE SANJAY KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek regular bail in connection with Bachwara Police Station Case No. 102 of 2017 registered for offences punishable under sections 326, 307, 120B/34 of the Indian Penal Code and 27 of the Arms Act.
It has been alleged that three FIR named accused came near the house of informant and shot fire causing injury to his brother on hip. The other six accused have been named as Conspirator of the occurrence. It has been submitted that the petitioners are husband and wife, aged about 72 and 70 years respectively, having clean antecedent and claimed that on account of local politics, their names have been divulged in this case. The
Patna High Court Cr.Misc. No.43516 of 2017 (2) dt.20-09-2017 2/2 petitioners are in custody since 08.07.2017.
Considering the facts and circumstances of the case, the petitioners, Ramchandra Choudhary and Manimala Devi are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned 7th Sub-Judge-cum-Additional Chief Judicial Magistrate-V, Begusarai in connection with Bachwara Police Station Case No. 102 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be local person having sufficient immovable property within the jurisdiction of the concerned Court. (ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
